Terms of Use

1. About these terms

These terms apply to the acum. app for iPhone and its Home Screen widgets, the website e-acum.md and the service at api.e-acum.md (together, “acum.”), provided by Roman Bitca, Republic of Moldova (“we”, “us”). By using acum. you accept these terms. If you don't agree, please don't use it.

If you got the app from Apple's App Store, Apple's Licensed Application End User License Agreement (the “Standard EULA”) also applies. If the two conflict about the app, the Standard EULA wins.

2. What acum. does

acum. brings public information together in one place: the official exchange rates of the National Bank of Moldova, the buy and sell rates published by commercial banks, the fuel prices and gas-station registry of the National Agency for Energy Regulation (ANRE), and border-crossing wait times and cameras from the border authorities. acum. is free, with no account, no ads and no in-app purchases.

3. Information only: please check before you act

• The data comes from third parties and is refreshed on a schedule, so it can be delayed, incomplete or wrong, for example when a source changes its website.
• Bank rates are the cash rates the banks publish. The rate you actually get can differ, for example by card, by amount or later in the day.
• Fuel prices are the maximum retail prices set by ANRE and the prices that stations report to it. The price at the pump can differ.
• Border wait times are estimates that can change quickly, and cameras can be offline.
• Distances and drive times are approximate.

acum. is not financial, investment or legal advice, and it doesn't offer to buy or sell anything. Please confirm anything important with the bank, gas station or border authority before relying on it.

4. Using acum.

You may use acum. for your own personal, non-commercial purposes. Please don't:

• use it to break the law or to mislead others, for example by presenting its data as official figures;
• overload or disrupt the service, for example with automated bulk requests to api.e-acum.md, which exists to serve the app and isn't a public API;
• try to get into systems or data you're not meant to access.

We may limit or block use that breaks these rules.

5. Third parties

The data belongs to its sources, and their own terms apply to it. Bank names, fuel brands and other trademarks belong to their owners. acum. is independent: it isn't affiliated with or endorsed by the National Bank of Moldova, ANRE, any bank, any fuel company or any border authority. Directions open in the maps app you choose, and cameras stream from the Border Police; we don't control those services.

6. Ownership

The app, its design, and the name and logo acum. belong to Roman Bitca. You get a personal, non-transferable licence to use the app on Apple devices that you own or control, as set out in the Standard EULA. We can end it if you break these terms.

7. Availability and changes

acum. is free of charge. We may change, pause or stop any part of it at any time, and we can't promise it will always be available or free of errors.

8. No warranty

To the extent the law allows, acum. is provided “as is” and “as available”, without warranties of any kind, including that the information is accurate, complete or up to date.

9. Limitation of liability

To the extent the law allows, we aren't liable for loss or damage from using or relying on acum., for example exchange-rate differences, fuel costs or time spent at a border, or for any indirect or consequential loss. Nothing in these terms limits liability that the law doesn't allow us to limit, or affects your statutory rights as a consumer.

10. Apple

If you got the app from the App Store:

• These terms are between you and Roman Bitca, not Apple. Apple isn't responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app. For help, contact us (section 13).
• If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any (acum. is free). To the maximum extent the law allows, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If anyone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you aren't located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a “terrorist supporting” country, and that you aren't listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

11. Governing law

These terms are governed by the laws of the Republic of Moldova, and disputes go to the competent courts of the Republic of Moldova. If you're a consumer living elsewhere, you keep the protection of the mandatory laws of your country and can also bring a claim in your local courts.

12. Changes to these terms

We may update these terms. We'll post the new version here with a new date and mention important changes in the app's release notes. If you keep using acum. after a change, the updated terms apply.
